It’s Time to Smile Program
Oklahoma Dental Implants and Oral Surgery
Locations: Norman, Edmond, and Lawton, Oklahoma
Program Period: February 1, 2025, to February 28, 2025
1. PROGRAM OVERVIEW
The "It’s Time to Smile Program" is a promotional initiative to provide selected participants with complimentary or reduced-cost dental treatments at the discretion of Oklahoma Dental Implants and Oral Surgery. Acceptance into the program is not guaranteed, and benefits may vary based on individual cases, availability of resources, and clinical assessments.
2. ELIGIBILITY
Applicants must:
- Be legal residents of the United States.
- Be 18 years or older at the time of entry.
- Reside within a 50-mile radius of Norman, Edmond, or Lawton, Oklahoma.
- Provide proof of residency (e.g., government-issued ID or utility bill) upon request.
- Be able to demonstrate financial need.
Employees, contractors, or affiliates of Oklahoma Dental Implants and Oral Surgery and their immediate family members are not eligible to participate. The Sponsor reserves the right to disqualify Applicants without proof of eligibility or those with pending legal/medical disputes.
3. HOW TO APPLY
To enter the Program:
- Submit a completed application via the Sponsor’s website by February 28, 2025, at 11:59 PM CST.
- Include a personal statement, photos, or other requested materials.
- Consent to the Terms & Conditions and provide accurate contact information.
- Provide documentation of financial need.
Submissions received after the deadline will not be reviewed or considered. The Sponsor reserves the right to disqualify incomplete or inaccurate applications.
4. SELECTION PROCESS
Eligible applications will be reviewed by the Sponsor’s panel based on the following criteria:
- Medical need for treatment.
- Impact of treatment on the Applicant’s quality of life.
- Availability of resources.
Selected participants will be notified by March 15, 2025. Decisions are final and not subject to appeal.
5. PARTICIPATION REQUIREMENTS
Applicants selected for the Program agree to:
- Attend all required consultations and appointments.
- Follow prescribed treatment plans.
- Allow their likeness, photos, and statements to be used for promotional purposes (see Section 9).
- Adhere to the Program’s rules and policies.
Failure to comply may result in disqualification and termination of benefits.
6. RESPONSIBILITIES OF ENTRANT
(A) Representations/Warranties as Conditions of Entry/Participation in Program
By participating in this Program, an Applicant represents and warrants that:
- He/she is of the legal capacity to participate in this Program.
- He/she owns all rights and title to his/her Submission and that the Submission is solely his/her own original work.
- The Submission does not infringe on the intellectual property, privacy, publicity rights, or any other legal or moral rights of any third party.
- Throughout his/her participation in this Program, he/she will conduct himself/herself in an appropriate manner and not engage in any behavior or manner that would embarrass the Sponsor, Program Entities, or reflect negatively on Oklahoma Dental Implants and Oral Surgery’s practice, services, or products.
(B) Grants/Waivers
By submitting a Submission, an Applicant grants Oklahoma Dental Implants and Oral Surgery, their affiliates, legal representatives, assistants, agents, and licensees an irrevocable, perpetual license to copy, transmit, publish, post, broadcast, display, adapt, exhibit, reproduce, encode, store, and/or otherwise use his/her Submission, as submitted or edited/modified in any way, for purposes related to the Program or its promotion.
Applicant acknowledges and agrees:
- He/she will not receive compensation or royalty in exchange for granting these rights, aside from any dental treatment received under this Program.
- All intellectual property rights, privacy/publicity rights, or other legal or moral rights that might limit the Sponsor’s use of the Submission, recordings, photos, or videos are waived.
- The Applicant agrees not to assert any claim against the Program Entities arising from the use of the aforementioned materials.
(C) Indemnification/Release
By submitting a Submission, the Applicant agrees to indemnify and hold harmless the Program Entities from any claims, damages, expenses, or costs (including reasonable attorneys’ fees) arising from:
- The Submission.
- Conduct during participation in the Program.
- Claims of intellectual property infringement, privacy violations, defamation, or other legal issues.
The Applicant releases and holds harmless the Program Entities from any claims that advertising or Program materials infringe on the Applicant’s rights.
7. INTERNET/LIMITATIONS OF LIABILITY
No liability or responsibility is assumed by Oklahoma Dental Implants and Oral Surgery or the Program Entities resulting from:
- Participation in the Program.
- Network, server, or connection interruptions.
- Miscommunications, failed transmissions, technical errors, or other malfunctions.
- Damage to any person’s computer due to participation.
Persons tampering with the Program’s operations may be disqualified and subject to prosecution. Any attempt to apply using multiple email addresses or identities, or interfering with the Program’s proper operation, may result in disqualification. Robotic, automatic, macro, or third-party methods of participation will void entries.
If the Program cannot operate as intended due to technical issues, unauthorized intervention, or insufficient Applicants, the Sponsor reserves the right to modify, suspend, cancel, or terminate the Program.
CAUTION: Any attempt to deliberately damage the Program’s website or operations is a violation of criminal and civil laws. The Sponsor reserves the right to seek damages or remedies to the fullest extent permitted by law.
8. PRIVACY POLICY
Any personally identifiable information collected during an Applicant’s participation will be handled by Oklahoma Dental Implants and Oral Surgery or its representatives in compliance with these Terms and Conditions and the Health Insurance Portability and Accountability Act (HIPAA).
9. PUBLICITY RIGHTS
By participating in this Program, an Applicant grants Oklahoma Dental Implants and Oral Surgery and its designees the perpetual right to use his/her name, biographical information, photos, likeness, videos, and statements for trade, commercial, advertising, and publicity purposes. This includes all media formats worldwide, including but not limited to websites, social media, and advertising materials, without notice, review, approval, or additional compensation except where prohibited by law.
10. RELEASE
By participating in the Program, each Applicant releases and agrees to indemnify and hold harmless the Program Entities from:
- Any claims, damages, or injuries (including death) to persons or property arising directly or indirectly from participation in the Program.
- Any violations of personal rights, including publicity/privacy violations, libel, or slander.
11. DISPUTE RESOLUTION
Except where prohibited, participation in the Program constitutes an agreement that:
- Any disputes will be resolved exclusively in the appropriate Oklahoma State Court or Federal Court.
- Disputes will be handled individually, without resorting to class action.
- Any damages awarded will be limited to actual out-of-pocket costs, excluding attorneys’ fees or punitive damages.
- Injunctive or equitable relief is not permitted; damages must be sought through action at law.
- All issues related to these Terms & Conditions will be governed by the laws of the State of Oklahoma. If any provision is deemed invalid, the remaining provisions remain enforceable.
12. GENERAL
Each Applicant waives any right to claim ambiguity in these Terms & Conditions. All submissions become the property of the Sponsor and will not be returned. Disputes over participant identity will be resolved based on registration information. All federal, state, and local laws apply. The Program is void outside Oklahoma and wherever prohibited.
